The position of historic parks and gardens in the English planning system is anomalous. While other elements of the heritage are protected by a series of specific controls which have evolved over a century or so, parks and gardens have only relatively recently become a material factor in planning decisions. This paper places parks and gardens in the context of other heritage protection and traces the development of planning practice since the creation of the English Heritage Register of nationally important sites. The paper then discusses the issue of specific statutory controls, and the possible aim and objectives. Finally, an outline structure of a system of statutory control is formulated.
