The Cartagena Protocol to the Convention on Biological Diversity makes provision for the development of a liability mechanism to mediate laibility issues arising form trade in living modified organisms. The EC Environmental Liability Directive of 2004 is a model that the CBD working group on liability has considered, and is often suggested as a model for wider adoption in this area. This chapter analyses the requirements of the Catagena Protocol, and considers the options that the EC Liability model offers for wider adoption in internatitnal conventions on civil and environmental liability.
