This is the first of two volumes of a comparative study performed by the Research Training Network ‘Fundamental Rights and Private Law in the European Union’, funded by the European Community. It offers an overview of the doctrines and case law on the horizontal effect of fundamental rights in England, France, Germany, Italy, the Netherlands, Poland, Portugal, Spain and Sweden. National reports for each of these countries are preceded by a brief introduction explaining the project terminology and methodology, and followed by comparative observations. In addition, a contribution on the horizontal effect of fundamental rights and freedoms in EU law is included. The main focus on this comparative study lies on the practice of adjudication. In this context, “horizontal effect” means the (direct or indirect) application of a fundamental right, i.e. a national constitutional right or an international human right, in order to solve a dispute between private parties.
